Ordering Methods and Pricing
Customers may place all their orders through the website: WWW.THULOS.COM
The minimum purchasing age is 18 years old.
Each customer declares that they have full legal capacity to use credit cards and that such cards have sufficient funds to cover all costs resulting from the purchase of products through THULOS.COM.
By pressing the “Pay” button during the purchase process, the customer declares full and unconditional acceptance of these General Terms and Conditions of Sale.
The data recorded by G. MOTIRAM, S.L. constitutes proof of the transactions carried out between G. MOTIRAM, S.L. and the members of its Private Community. G. MOTIRAM, S.L. will confirm the order by sending an email.
The contractual information is presented in Spanish and will be confirmed at the latest upon delivery.
All taxes are included in the prices of our products.
G. MOTIRAM, S.L. reserves the right to modify its prices at any time; however, products will be invoiced according to the rates in force at the time the order is registered (subject to product availability).
The products shall remain the property of the supplier until full payment of the price has been received.
G. MOTIRAM, S.L. reserves the right to reject any order from a customer with whom it has an ongoing dispute.
Availability
G. MOTIRAM, S.L. will make every effort to satisfy all customer demand for products.
Depending on this demand, the speed of the refund to the customer’s bank account will depend on the type of bank card used and the conditions established by each banking institutio
Security
For your security, G. MOTIRAM, S.L. has entrusted credit card payment processing to a secure payment gateway.
The banking details entered are encrypted and securely transmitted to the servers of the banking institution and are subsequently verified with the issuing bank in order to prevent possible fraud and abuse.
This data transmission procedure is guaranteed by SSL (Secure Socket Layer) 128-bit encryption technology, one of the most advanced and effective protection systems currently available. Thanks to this technology, no third party can access via the Internet the banking information provided by the customer.
Only the Bank and PayPal have access to the banking details linked to these payment methods. Therefore, G. MOTIRAM, S.L. does not know or store these details during the payment process.
Return of an unwanted or non-conforming product
All products sold may be returned within 14 days from the date of receipt of the product, in accordance with the provisions of Spanish Retail Trade Law.
This right of withdrawal shall apply exclusively to products returned in the same condition in which they were received.
The product must be returned in the same condition in which it was received, including instructions, documents, and product packaging.
Otherwise, the product may suffer depreciation in value. No refund will be issued if the product has been misused or used beyond the mere verification of its good condition and proper functioning.
Products must be sent to the address specified by G. MOTIRAM, S.L. in the return instructions sent by email. The direct costs arising from exercising the right of withdrawal shall be borne by the consumer.
Packages that do not include any element allowing identification of the sender (order number, name, address, etc.) cannot be accepted.
Any person returning a product will receive an email informing them of the refund amount (excluding shipping costs). The refund will be processed as quickly as possible using the same payment method originally used (PayPal, credit card, or bank transfer).
Return of a Defective Product
To proceed with the return of a defective product, please contact us via email at contacto@thulos.com, providing the following information: description of the damage or defect, product reference, purchase date, full name, shipping address, and a contact telephone number. Products must be returned properly protected. They must be sent to the address specified by G. MOTIRAM, S.L. in the return instructions sent by email.
Once the product has arrived at our facilities, it will be inspected. If a defect or fault is confirmed, or if it is determined that the product does not match the order placed, the customer will be informed by email and may choose between a full refund or the shipment of a replacement product at no additional cost.
In the event of a return or replacement, the process will be carried out as soon as possible. The customer will be informed by email confirming whether the defective product will be refunded or replaced.
Amounts paid for products returned due to an actual defect or fault will be fully refunded, including shipping costs. Refunds will be made using the same payment method used for the purchase.
The company reserves the right to void the warranty if it is determined that the malfunction has not been caused by the manufacturer’s system or design. In such cases, shipping costs will be borne by the customer.
As specified in the following section “Warranty”, the seller is liable for any lack of conformity that becomes apparent within two years from delivery. The consumer must inform the seller of the lack of conformity within two months of becoming aware of it.
Warranty
Warranties and after-sales services shall be governed by Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Protection of Consumers and Users.
According to this regulation, the seller is obliged to deliver products that conform to the contract and shall be liable for any lack of conformity. In the event of a defective product, the seller shall proceed, as appropriate, with repair, replacement, price reduction, or termination of the contract, all of which shall be free of charge for the consumer and user.
The seller shall be liable for any lack of conformity that becomes apparent within two years from the date of delivery. The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it.
G. MOTIRAM, S.L. shall not be responsible for any damage resulting from misuse, improper handling, or non-professional installation. The warranty shall not be valid in the event of factors external to the normal use of the product, such as power surges or drops, use of unsuitable or manufacturer-prohibited accessories, falls, water damage, fire, or incorrect or abusive handling by the customer or unauthorized third parties.
Commercial Warranty: Manufacturers may offer additional warranties whose scope and duration may vary depending on the product and brand. Such warranties shall be the sole responsibility of the manufacturer providing them.
The warranty period shall begin on the date of delivery.
Liability, Disputes and Applicable Law
These Terms and Conditions shall be governed by Spanish law. The parties, in accordance with Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, submit to the Courts and Tribunals corresponding to the User’s place of residence.
Identity and Address of the Data Controller
In accordance with Organic Law 15/1999 of December 13 on the Protection of Personal Data, G. MOTIRAM, S.L., with registered office at C/ Ciro Alegría, 45 – 29004 Málaga, Spain (hereinafter referred to as the “Data Controller”), informs you that by entering your data through the electronic forms on our website, you will provide certain personal data which will be processed automatically and incorporated into the corresponding files for which Aroon Aswani is the owner and controller.
Purpose of the Processing of Your Data
The collection and automated processing of your personal data is intended to enable your participation in contests and promotions offered through our website WWW.THULOS.COM, as well as to receive our Newsletter should you so wish.
By accepting this policy, you consent to the processing of your data for the purpose of sending advertising promotions and commercial communications through any means, including electronic communications, by G. MOTIRAM, S.L. and other companies related to the telecommunications, financial, leisure, training, consumer goods, automotive and energy sectors.
Rights of Access, Rectification and Cancellation
At any time, you may exercise your rights of access, rectification, cancellation and objection by sending a signed written request to the Legal Department of G. MOTIRAM, S.L., together with a photocopy of your ID document, to the postal address indicated above or to the following email address: contacto@thulos.com.
Likewise, at any time you may revoke the consent previously granted for the transfer of your personal data and the receipt of commercial communications by sending a message to the above-mentioned email address indicating the word “Unsubscribe” in the subject line.
Data Disclosure
If you are selected as the winner of any of our contests or promotions, you authorize the publication of your personal data on our website and on the social media profiles of G. MOTIRAM, S.L. on Facebook, YouTube, Twitter, Instagram, Google and Pinterest for the purpose of announcing the winner.
Likewise, you consent to the communication of your data to external providers of G. MOTIRAM, S.L. related to the telecommunications, financial, leisure, training, consumer goods, automotive and energy sectors, for the purpose of sending advertising promotions and commercial communications.
